Dear Expert,
There is a growing body of cases in which judges have criticised experts and lawyers over the preparation of the joint statement.
Bond Solon offer half-day Discussions between Experts course runs virtually on the following dates:
13 February 2025 (9.30am - 1pm)
21 May 2025 (1:00pm - 5:00pm)
The rules and the case law make it clear that lawyers are not to be involved in the drafting of the joint statement, however, the rules do allow for a very limited intervention by the lawyers in exceptional circumstances.
This session examines those exceptional circumstances so that the expert witness does not risk criticism from the judge. In addition, participants on this course will understand:
• What the judges are expecting from the experts' discussion
• What the rules require
• How to prepare for the discussion
• How to conduct the discussion
Key Learning Points:
• Understand the legal requirements and implications of discussions between experts.
• Prepare for the discussion between experts.
• Outline the agenda of the discussion between experts.
• Gain an overview of the Statement of Agreement and Disagreement, and minutes of the meeting.
• Be able to confidently respond to an instruction from the solicitor to avoid reaching agreement.
• Work with an expert who is not complying with their duties to the court.
